TERMS OF USE

I. General Terms:

These terms of use (“Terms of Use”) apply to all users on Lislux, including Advertisers. Lislux provides online advertising services (“Services”) in accordance with the Terms of Use. Please read the Terms of Use carefully. Lislux offers users services in exchange for the user's agreement to comply with these Terms of Use. By accessing or using the services, you agree to comply with and be legally bound by these Terms of Use. If you do not wish to be bound by these Terms of Use, please do not access or use the services. The Terms of Use apply to all posts, messages, texts, files, images, photos, videos, sounds, or other materials (“Content”) on Lislux.

In addition, when using specific services, you agree to comply with all principles currently posted for all services, which may change over time. If you object to any terms or conditions of the Terms of Use, any guidelines, or any subsequent modifications, or if you are not satisfied with Lislux in any way, your only remedy is to cease using the services immediately. Lislux has the right, but not the obligation, to enforce the Terms of Use.

If you want to post an advertisement on Lislux, you must agree to these Terms of Use. By posting an advertisement on Lislux, you agree to these Terms of Use. If you do not wish to be bound by these Terms of Use, please do not post any advertisements on Lislux. Any and all advertisements you post will be governed by these Terms of Use.

II. Regulations on Modifications to Terms of Use:

Lislux has the right, at its sole discretion, to change, modify, or alter these terms and conditions at any time. Such changes will be effective immediately upon publication. You must review this agreement regularly to ensure that you are familiar with the current Terms of Use.

III. General Regulations:

All rights, ownership rights and interests in and to the content are the property of or used with permission from Lislux and are protected by applicable law. You understand that all content posted on, transmitted through, or provided via the service is the sole responsibility of the person from whom the content originated. More specifically, you are entirely responsible for each individual item ('Item') of content that you post or provide through the service. Lislux does not control and is not responsible for content provided through the service, and by using the service, you may be exposed to content that is offensive, inappropriate, inaccurate, misleading, or otherwise objectionable. Lislux does not guarantee the security or privacy of your information in any way when contacting other individuals through the Lislux website.

Furthermore, the Lislux website and content available through the service may contain links to other websites that are completely independent of Lislux. If you link to other websites, you do so at your own risk. Lislux clearly states that they are not responsible in any way for other websites. Please note that such linked websites may have privacy statements and/or terms of use that differ from Lislux. You agree that you must evaluate and bear all risks associated with the use of any content, that you cannot rely on the aforementioned content and in any case, Lislux will not be responsible in any way for any content or for any loss or damage arising from the use of any content posted or provided through the service.

Lislux does not pre-screen or approve content, but Lislux shall have the right (but not the obligation) at its sole discretion to refuse, delete, or move any content available through the service, for violating the Terms of Use or Privacy Policy or for any other reason.

IV. Regulations on Content, Websites and Services of Third Parties:

Our website and content are available through services that may contain features and functionalities that can link you or provide you access to third-party content (for example: other websites) completely independent of Lislux.

Your interactions with any individuals or entities you have encountered through the service, including payments and the delivery of goods or services, and any terms, conditions, warranties, or other representations related to those transactions, are solely between you and that individual or entity. You should conduct any inquiries that you feel are necessary or appropriate before proceeding with any online or offline transactions with any of these third parties. We advise you to exercise caution when interacting with other individuals or entities.

You agree that Lislux will not be liable or held responsible for any loss or damage of any kind arising from any such transactions. If there is a dispute between users on our website or between a user and any third party, you understand and agree that Lislux has no obligation to participate. In the event that you have a dispute with one or more other users, you expressly and irrevocably release Lislux from any claims and damages arising from or in any way related to those disputes and services.

V. Sanctions and Measures for Handling Violations of Regulations or Non-Compliance with Rules:

If for any reason you believe that your work has been copied in a way that constitutes a copyright infringement or that your intellectual property rights have been violated, please notify the customer service department of Lislux.

In such cases, please provide complete details to our customer service department so that Lislux can identify the material you believe is infringing and describe the infringement. Please provide your contact information.

VI. User Content Terms:

YOU OWN ALL YOUR USER CONTENT, INCLUDING ANY IMAGES YOU UPLOAD TO THE SITE.

At a high level, the service allows you to upload and post your photos, as well as text in written form, images, web links, location information, and other content ("User Content"). Any user content that you provide on the service will belong to you or your licensors. We will not claim any ownership rights to your User Content - it is 100% yours.

You grant us a non-exclusive, royalty-free license (with the right to sublicense) to store, archive, transfer, display, modify, perform, copy, adapt, translate, and distribute your user content (in whole or in part) in any media format and through any communication channels (currently known or developed later). You understand that we will not pay you for any use of your images, and your images will be made publicly available for use without providing you with credit or compensation.

Authority when you upload photos to the service, in addition to the license you grant us to publicly post the Photos and allow other users to download and use them, you also authorize us under your copyright to enforce any violations of the ancillary licenses we grant in the Photos to others. In other words, if a user abuses one of your Photos downloaded from the service, you authorize us to enforce your copyright in the Photos on your behalf.

Representations and warranties, you are fully responsible for your user content and any consequences that arise from your uploading or posting user content on Lislux. Each time you upload or post user content, you represent and warrant to us that:

You are the creator and owner of the user content or have all the necessary rights from other individuals or companies to use and allow other users to use your user content on the Service as contemplated in Section 6; and Your User Content (including its use by you, us, or other users of the Service) does not and will not infringe or misappropriate any rights of any third party, including copyright and other intellectual property rights, privacy rights, publicity rights, or moral rights, or defame, slander, or libel anyone. In other words, your User Content must be your original work and you must have the permission of any third party that holds rights to the User Content before you upload or post User Content to the Service.

Disclaimer: There is no reasonable way for us to monitor all User Content uploaded or posted on the Service, and we have no obligation to you or other users to monitor, edit, or control the User Content that you and other users upload or post on the Service. This means that we are not responsible for any User Content on the Service, and you agree not to make any claims against us regarding User Content. That said, we may remove, edit, filter, or block any User Content from the Service at any time (without prior notice to you) for any reason, including if we believe that the User Content violates these Terms or is objectionable. When you use the Service, you will encounter User Content from other users, some of which may be offensive, inaccurate, or inappropriate. We may investigate complaints alleging that User Content violates these Terms, and in such cases, we will decide on our own what action (if any) to take regarding the mentioned User Content.

VII. Information Management on the Website:

In order for Lislux to function as an elegant operating environment, there are certain restrictions regarding what you can post on the website. Therefore, you agree not to post, email, upload, transmit, or otherwise process or provide Content in any way:

It is illegal, harmful, threatening, abusive, harassing, infringing on the privacy of others, or harming minors in any way;

It is content that is pornographic or describes a person engaging in actual sexual acts or other sexual behavior;

Harassment, belittling, threatening, or hatred against an individual or group based on political inclination, religion, gender, sexual orientation, race, ethnicity, age, or disability;

It impersonates any individual or organization or falsely claims or misrepresents your affiliation with any individual or organization;

This includes personal or identifying information about others without their explicit consent;

That is a falsehood, deceitful, misleading, fraudulent, or misinformation;

That violates any intellectual property rights of any party or content that you do not have the right to provide under any legal relationship or contract.

That constitutes "affiliate marketing", "spam", "junk mail", "fraudulent efforts", "chain letters", "pyramid schemes" or unwanted commercial advertising;

Advertising any illegal services or selling any items that are prohibited or restricted by current law.

Contains viruses or any computer code, files, or programs designed to disrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.

This disrupts the normal flow of dialogue with excessive content (flooding attacks) against the Service or negatively affects the usability of the Service for other users.

It uses misleading email addresses or spoofed headers or other manipulated identifiers to disguise the source of the Content transmitted through the Service; or

This violates any agreements such as the confidentiality agreement.

Additionally, you agree not to:

Engage in any activities that restrict any other person's use or enjoyment of the Services;

Contact anyone who has requested not to be contacted, or unwantedly contact anyone for any commercial purpose, or track or harass anyone;

Collect personal data about other users for commercial or illegal purposes;

Modify, delete, intervene in or damage any part of Lislux.

Use automated means to download data from the Service, including using unless explicitly permitted by Lislux;

Use "posting agents" which means agents, services, or third-party intermediaries that propose to post Items on behalf of others unless explicitly approved by Lislux.

Attempt to gain unauthorized access to Lislux's computer systems or engage in any activity that disrupts, degrades, interferes with the performance of, or weakens the functionality of the Service or the Lislux website.

In general, you agree not to take any actions (a) that may interfere with, harm, or exploit Lislux's business operations; (b) that may overload or impose an undue burden on Lislux's infrastructure; (c) that are used in connection with or for the benefit of any commercial enterprise or competing business; (d) that constitute unauthorized use or practice in violation of these Terms of Use or the Privacy Policy; (e) that delete, alter, or obscure any copyright or trademark notice, name, label, logo, URL, content or item, including but not limited to company names, contact information, trademarks, logos or URLs, or framing any content; and (f) that violate any applicable laws or regulations.

VIII. Regulations on User Access Rights:

Lislux grants you a limited, revocable, non-exclusive license to access the Services for your personal use. This license does not include: any collection, aggregation, copying, reproduction, display, or derivative use of the Services, as well as any use of data gathering and extraction tools for any purpose unless explicitly permitted by Lislux.

IX. Privacy Policy:

Lislux has established a Privacy Policy to explain to users how their information is collected and used, which you also agree that you are familiar with and that forms part of your agreement while using the Services. You acknowledge and further agree that Lislux may, at its sole discretion, retain or disclose your Content, as well as your information, such as email address, IP address, timestamps, and other user information, if required by law or other administrative orders, or otherwise to enforce the Terms of Use; respond to claims that any Content violates the rights of third parties; respond to claims that the contact information of third parties has been posted without consent; protect the rights, property, or safety of Lislux, its users, or others.

X. Regulations on Restrictions on the Use of Services:

You acknowledge that Lislux may establish limits related to the use of the Services, including but not limited to limits on the number of days that Content will be retained by the Services, limits on the number and size of posts, limits on the number and size of email messages or other Content that may be transmitted or stored by the Services, and the frequency with which you may access the Services. You agree that Lislux is not responsible or liable for the deletion or failure to store any Content maintained or transmitted through the Services. You acknowledge that Lislux has the right to modify or discontinue the Services (or any part thereof) at any time with or without notice and that Lislux will not be liable to you or anyone else for any modifications, suspensions, or discontinuations of the Services.

XI. Termination of Service:

You agree that Lislux, at its sole discretion, has the right to delete or deactivate your account, block your email or IP address, or terminate your access or use of the Service or any part of the Service, immediately and without notice, as well as to delete and remove any Content from the Service, for any reason, including but not limited to, if Lislux believes you have acted in violation of the Terms of Use or Privacy Policy.

If you wish to pause or stop advertising with Lislux, you can do so by informing your manager or making a request before your next payment date. The notice must be given at least 30 days before your subscription expires.

XII. Rights and Responsibilities of the Parties Involved in the Website:

The content displayed on or through the Service is protected by copyright, trademark rights, and international conventions. Any copying, modification, creation of derivative works from, or redistribution of the website or Content is prohibited without the explicit written consent of Lislux. You are not allowed to use any means to attempt to discover any source code contained in the Service.

Although Lislux does not require ownership rights to content posted by users, by posting Content in any public area of the Service, you automatically grant, and you represent and warrant that you have the right to grant Lislux an irrevocable, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute the aforementioned Content and to prepare derivative works or incorporate it into other works, the aforementioned Content and grant and authorize sublicenses of the above. Furthermore, by posting Content in any public area of the Service, you automatically grant Lislux all necessary rights to prohibit any aggregation, display, copying, reproduction, or exploitation of the Content on the Service by any party for any purpose thereafter.

You and anyone you designate cannot modify the Lislux website in any way, nor may you republish, copy, transmit, or distribute it for commercial purposes, create derivative works, or publicly display it in any form or by any means, unless permitted under these Terms of Use. No content in the Terms of Use or on the Lislux website will grant any license or rights, under any intellectual property rights of Lislux or under the intellectual property rights of any third party.

You or anyone you designate may not use, modify, adapt, reverse engineer, or exploit any Content, including but not limited to the Items, in whole or in part, unless expressly permitted by these Terms of Use.

Lislux may (but is not obligated to) enforce any and all of its intellectual property rights and other legal rights to the fullest extent permitted by law, and may seek damages, injunctive relief, attorney's fees, and criminal prosecution where appropriate. Any rights not expressly granted herein are reserved by Lislux.

XIII. Regulations on Warranty Refusal:

YOU AGREE THAT YOUR USE OF THE LISLUX WEBSITE AND SERVICES IS ENTIRELY AT YOUR OWN RISK. THE LISLUX WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. ALL EXPRESS AND IMPLIED WARRANTIES ARE DISCLAIMED. LISLUX DISCLAIMS ALL WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY AND PERFORMANCE OF THE WEBSITE. LISLUX DISCLAIMS ANY WARRANTIES REGARDING SERVICES OR OTHER GOODS OBTAINED THROUGH OR ADVERTISED ON THE LISLUX WEBSITE OR WEBSITES OR SERVICES LINKED TO THE LISLUX WEBSITE. LISLUX DISCLAIMS ALL WARRANTIES AGAINST VIRUSES OR OTHER HARMFUL COMPONENTS RELATED TO THE WEBSITE OR SERVICES.

XIV. Compensation and Liability Waiver Policy:

IN ANY CASE, LISLUX WILL NOT BE LIABLE FOR ANY DAMAGES IN ANY FORM, ARISING FROM ANY ASPECT OF YOUR USE OF THE LISLUX WEBSITE OR SERVICES, COMPLETELY REGARDLESS OF HOW SUCH DAMAGES OCCUR. SUCH LIMITATION WILL ALSO APPLY TO DAMAGES ARISING FROM REASONS RELATED TO SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE LISLUX WEBSITE OR SERVICES OR ANY LINKS ON THE LISLUX WEBSITE.

You agree to indemnify and hold LISLUX HARMLESS TO THE EXTENT PERMISSIBLE AND RELATED, either physically or legally, against any claims or demands, including reasonable attorney's fees and court costs incurred by any third party due to or arising from the Content you submit, post, or provide through the Service, your use of the Service, your violation of the Terms of Service, the AGREEMENT, or the ADVERTISER'S PRIVACY POLICY, your violation of any representations and warranties herein, OR BREACHING THE SPIRIT OF LISLUX AND THE APPLICABLE AGREEMENTS.

XV. Terms of Application:

The terms of use, privacy policy, and the relationship between you and Lislux will be governed by and construed in accordance with the laws of Vietnam, and must comply with the non-exclusive jurisdiction of the courts of Vietnam.

You and Lislux agree that any disputes and claims arising from or related to this contract, or the breach, termination, or invalidity of that contract, will be submitted to the competent court in Vietnam.

If any provision of the Terms of Use is found to be invalid by a court of competent jurisdiction, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Use shall remain in full force and effect. You agree that regardless of any contrary statute or law, any claim or cause of action arising from or related to the use of the Services or the Terms of Use must be filed within one (1) year after the claim or cause of action arises.
